最近又出了一起与竞业协议有关的案子:
字节跟踪前员工,偷拍他到快手上班,告他违反竞业协议,前员工被判退回竞业补偿7.8万,并赔偿字节违约金30万!
有人说,国内公司有什么牛逼技术值得竞业的?就是找个借口整员工。
有人说,这点钱对公司无所谓,杀鸡儆猴而已,告诫现在在职员工不要轻举妄动。劳动者没有权利,没有尊严,太悲哀了。
有人说,想跳槽的心拦住了也是躺平,何必呢?
有人说,竞业协议本质上就是个不平等条约,入职第一天签合同才能知道具体条款,只能选择签或者放弃入职,还有入职很久后才突然补签的,不签就让你离职。
有人说,离职就用竞业搞你,在职就用裁员搞你。竞业协议就是霸王条款,凭什么给月薪的30%就可以要求自己不去竞品?
有人问,为什么法律要认可竞业协议?难道要在一家公司待到退休?想跳槽就得转行吗?这是在鼓励和保护什么?
也有人说,字节玩竞业可是业内数一数二的,字节挖了阿里多少人?字节hr主动给做竞业规避,挂在不知名的公司,换个名字,干着字节的活。
还有人站在公司这边,说拿了竞业的钱就要有契约精神,要守约,否则就要做好心理准备,为自己的失信买单。
竞业协议的存在有其原因,最初的目的是为了规避不正当竞争,如果能够合理使用它,这本该是一件好事,但在实际操作中,竞业协议却沦落为无良公司对付员工的枷锁和工具。
许多公司利用竞业协议绑住员工,让他们在本就不大的圈子里寸步难行。对家大业大的公司来说,这点钱不算什么,可对于员工而言,摧毁的也许就是一个人的职业生涯和一个家庭的经济支柱。
如果公司非要竞业,可以,坚持原则,拒绝双标。一边不让自己的员工去对手公司工作,用跟踪偷拍这种手段把员工送上法庭,一边又偷偷摸摸招来对手员工给自己干活。又当又立,凭什么好事都让你占尽了?
